Terms of Service

These Terms of Service ("Terms") govern your access to and use of the Monitorion platform ("Service") provided by Monitorion ("we," "us," or "our"). By creating an account or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.
1. Service Description
Monitorion is a monitoring-as-a-service platform that provides website, API, and infrastructure monitoring. The Service includes up to 25 monitor types (HTTP, Ping, SSL, DNS, and others), 9 alert channels, multi-region check execution, public status pages, incident management, SLA reporting, and private network workers.

2. User Accounts
You must create an account to use the Service. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to:
- Provide accurate and complete registration information
- Keep your password secure and confidential
- Notify us immediately of any unauthorized use of your account
- Not share your account credentials with unauthorized individuals
We reserve the right to suspend or terminate accounts that violate these Terms or that we reasonably believe have been compromised.
3. Subscription and Billing
Free Plan.The free plan provides limited access to the Service at no cost. No credit card is required. The free plan may be modified or discontinued with 30 days' notice.
Paid Plans. Paid subscriptions (Pro, Business, Agency) are billed monthly or annually as selected at the time of purchase. All payments are processed by Paddle, our Merchant of Record. Paddle handles billing, invoicing, tax calculation, and refunds in accordance with their terms of service.
Pricing.Current pricing is displayed on our pricing page. We may change pricing with 30 days' advance notice. Price changes do not apply to your current billing cycle.
Cancellation. You may cancel your subscription at any time through your account settings. Upon cancellation, your paid features remain active until the end of the current billing period. After that, your account reverts to the free plan.
Refunds. Refund requests are handled by Paddle in accordance with applicable consumer protection laws. Contact [email protected] if you believe you are entitled to a refund.
SMS Credits. SMS alert credits are included with paid plans as specified in your tier. Additional SMS bundles may be purchased separately. Unused SMS credits do not roll over between billing periods.
4. Acceptable Use
You agree to use the Service only for lawful purposes and in accordance with these Terms. You shall not:
- Use the Service to monitor websites or services you do not own or have authorization to monitor
- Use the Service to conduct denial-of-service attacks, vulnerability scanning, or penetration testing against third-party systems
- Configure monitors at intervals designed to overwhelm or degrade the target service
- Attempt to circumvent rate limits, subscription tier restrictions, or security measures
- Use the Service to collect, store, or transmit personally identifiable information of third parties without their consent
- Reverse engineer, decompile, or disassemble any part of the Service
- Resell, sublicense, or redistribute the Service without our prior written consent (except for white-label features included in the Agency plan)
- Use the Service in any manner that could interfere with, disrupt, or negatively affect the platform or other users
We reserve the right to suspend or terminate your account for violations of this acceptable use policy.
5. Service Level Agreement (SLA)
Platform Availability.We commit to maintaining 99.9% uptime for the Monitorion platform for all paid plans, measured on a monthly basis. "Uptime" means the Service is operational and processing monitoring checks and delivering alerts. Scheduled maintenance windows are excluded from the uptime calculation.
Service Credits. If we fail to meet the 99.9% uptime commitment in a given calendar month, affected paid-plan customers may request service credits as follows:
- 99.0% to 99.9% uptime — 10% credit of that month's subscription fee
- 95.0% to 99.0% uptime — 25% credit of that month's subscription fee
- Below 95.0% uptime — 50% credit of that month's subscription fee
Service credit requests must be submitted within 30 days of the affected month. Credits are applied to future billing periods and are not redeemable for cash.
Exclusions. The SLA does not apply to: (a) free-plan accounts, (b) outages caused by factors outside our reasonable control (force majeure, internet infrastructure failures, third-party service outages), (c) features labeled as beta or experimental, or (d) abuse or violation of these Terms.
6. Intellectual Property
The Service, including all software, content, design, trademarks, and documentation, is owned by Monitorion and protected by intellectual property laws. Your subscription grants you a limited, non-exclusive, non-transferable license to use the Service for its intended purpose during the subscription term.
You retain ownership of all data you provide to the Service, including monitor configurations, check results, and account information. You grant us a limited license to process this data solely for the purpose of providing the Service.
Private Worker (OSS). The Monitorion private worker is released under the MIT License. The terms of that license govern your use of the private worker software.
7. Data and Privacy
Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your data. By using the Service, you consent to the data practices described in the Privacy Policy.
8. Limitation of Liability
To the maximum extent permitted by applicable law:
- The Service is provided "as is" and "as available" without warranties of any kind, whether express, implied, or statutory, including warranties of merchantability, fitness for a particular purpose, and non-infringement.
- We do not warrant that the Service will be uninterrupted, error-free, or completely secure.
- We are not liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, revenue, data, or business opportunities.
- Our total aggregate liability for any claims arising from or related to the Service shall not exceed the amount you paid us in the 12 months preceding the claim.
Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law (such as liability for fraud or death/personal injury caused by negligence).
9. Indemnification
You agree to indemnify and hold Monitorion harmless from any claims, damages, losses, or expenses (including reasonable legal fees) arising from: (a) your use of the Service, (b) your violation of these Terms, (c) your violation of any third-party rights, or (d) the content or data you provide to the Service.
10. Termination
By you. You may terminate your account at any time by contacting us at [email protected] or through your account settings. Active subscriptions will continue until the end of the current billing period.
By us.We may suspend or terminate your access to the Service immediately if you violate these Terms, fail to pay applicable fees, or if we are required to do so by law. We may also discontinue the Service entirely with 90 days' advance notice to active paid subscribers.
Effect of termination. Upon termination, your right to use the Service ceases. We will retain your data for 30 days after termination to allow for export, after which it will be permanently deleted.
11. Changes to These Terms
We may modify these Terms at any time by posting the revised version on this page and updating the "Last updated" date. For material changes, we will notify active users via email at least 30 days before the changes take effect. Your continued use of the Service after the effective date constitutes acceptance of the revised Terms.
12. General Provisions
Governing Law. These Terms are governed by the laws of the jurisdiction in which Monitorion operates, without regard to conflict-of-law principles.
Severability. If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
Entire Agreement. These Terms, together with the Privacy Policy and any applicable order forms, constitute the entire agreement between you and Monitorion regarding the Service.
Waiver. Our failure to enforce any right or provision of these Terms does not constitute a waiver of that right or provision.
